Waiver of Recruitment - MSP


Note: A department may request that an open recruitment process be waived in exceptional circumstances only as it is the intent of the University of California, Davis to actively post and recruit for all positions in order to obtain a competitive and diverse applicant pool. However, if a department is contemplating a waiver of recruitment they must first obtain approval by the Associate Vice Chancellor - Human Resources. The department shall not discuss salary with the candidate until the position has been classified by Compensation Services.


Department Responsibilities:

  • The department sends the request for a waiver of recruitment via memo to the Associate Vice Chancellor - Human Resources. The hard copy packet shall include the position description, employment application of candidate and written justification for waiver emphasizing special circumstances. These special circumstances may include:

    • A candidate possesses unique skills, knowledge and abilities and there are no other viable candidates available.

    • There are demonstrated recruitment difficulties, such as a requirement of technical skills and a limited number of qualified individuals in the general work force.

    • There are time or funding constraints or other demonstrated business necessity. Business necessity may include causing undue disruption of critical departmental services. Examples may include causing serious fiscal impact, such as the delay or cancellation of a grant or diminished clinical research.

    • A new program is being transferred in its entirety to the University and identified employees are already in place.

  • The packet should also include the following information:

    • Candidate's name

    • Title of the Position

    • Proposed salary

    • Type of appointment

    • Appointment percentage

    • Duration of appointment

    • Employee's duties and responsibilities

    • Reason/reasons behind the waiver request

    • Anticipated start date


Associate Vice Chancellor - Human Resources Responsibilities:

  • Forwards the position description to Compensation for review of appropriate classification.


Compensation Responsibilities:

  • Reviews the position description for appropriate classification.

  • Advises the Associate Vice Chancellor - Human Resources and MSP Coordinator of decision.


Associate Vice Chancellor - Human Resources Responsibilities:

  • Reviews documents submitted in the packet to include review for recruitment difficulty, justified business necessity, etc.

  • Contacts department with decision.


Department's Responsibilities:

Once initially approved, the Associate Vice Chancellor - Human Resources Office will require the following documents for the employee's file:

  • Signed employment application

  • Signed position description

  • Signed contract (if applicable)
