Chavez Holiday, Domestic Partner Sick Leave, and Trial Employment Proposals

Proposal to revise Policy 40 (Holidays) regarding Cesar Chavez/Spring Holiday, Policy 42 (Sick Leave) regarding domestic partners, and Policy 81 (Reasonable Accommodation) regarding trial employment.

Based on consultation with various groups, the Office of the President has proposed to modify three sections of Personnel Policies for Staff Members, and the list of holidays for academic employees.

Policy 40 (Holidays), proposes renaming the spring administrative holiday in honor of Cesar Chavez, founder of the United Farmworkers Union. Cesar Chavez Day would be observed on the last Friday in March. Currently, UC Davis observes the Spring Holiday on the last Monday in March. All campuses would be required to make the transition by 2005. A similar change would be made for employees covered by the Academic Personnel Manual; however, Section APM-720 does not need to be revised because it does not enumerate the actual holidays.

Policy 42 (Sick Leave) proposes to add domestic partners to the list of family members for whom an employee may use sick leave. Although the list currently includes "members of the household," this change is required by recent changes in state law. UC Davis currently specifically names domestic partners as a local implementation note.

Policy 81 (Reasonable Accommodation) proposes technical corrections adding trial employment in contract or per diem positions as a form of reasonable accommodation. Currently, the policy only allows limited positions. UC Office of the President has published the following documents:

The proposal on Cesar Chavez Day would affect staff employees covered by Personnel Policies for Staff Members, and academic employees covered by the Academic Personnel Manual. The other two proposals would affect employees who are covered by Personnel Policies for Staff Members.

For represented academic and staff employees, these proposals will be subject to collective bargaining negotiations.
