Confidential Employee Legal Definition
The Collective Bargaining Unit Codes for employee categorized as "confidential" differ from those for the "non-confidential" employees. The confidential codes may only be used for employees that meet the definition of "confidential employee" as it is stated in the Higher Education Employer-Employee Relations Act (HEERA) of 1978.
A "confidential employee" means an employee who is required to develop or present management positions with respect to meeting and conferring or whose duties normally require access to confidential information which contributes significantly to the development of such management position.
